The short version

By using our website and joining our waitlist, you agree to a few basic rules: you're 18 or older, you'll give us a real email address, you won't try to hack or abuse the site, and you understand that we may change or shut down the waitlist at our discretion. The full terms are below.

1. Agreement to these terms

These Terms of Use ("Terms") govern your access to and use of the Tiny Tickets website at tinytickets.app (the "Site") and any related services we provide before the launch of our full product, including our pre-launch waitlist (collectively, the "Services").

By accessing the Site, joining our waitlist, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

These Terms form a binding legal agreement between you and Tiny Tickets, a company registered in New York ("we," "us," or "Tiny Tickets"). Please read them carefully.

2. Who can use the Services

Age requirement

You must be at least 18 years old to use the Services or join our waitlist. By using the Services, you represent and warrant that you are 18 or older. If you are under 18, please do not use this Site or provide any information to us.

Geographic availability

The Services are intended primarily for users in the United States. While our Site is accessible from other countries, we make no representations that the Services are appropriate or available for use in any particular location. Those who access the Site from other jurisdictions do so on their own initiative and are responsible for compliance with local laws.

3. The waitlist

What the waitlist is

Our pre-launch waitlist allows interested parents, caregivers, and providers of children's activities to sign up to receive notifications about Tiny Tickets, including product updates and an announcement when our full product becomes available.

Our right to modify or discontinue

We reserve the right to modify, suspend, or discontinue the waitlist or any part of the Services at any time, without notice and without liability to you. This includes the right to remove you from the waitlist at our discretion, including for violation of these Terms or for any other reason.

5. Intellectual property

Our content

The Site and all of its content — including text, graphics, logos, images, software, and the "Tiny Tickets" name and branding — are owned by Tiny Tickets or our licensors and are protected by United States and international intellectual property laws. You may not use any of this content without our prior written permission, except as expressly allowed by these Terms.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use, in accordance with these Terms. This license does not include any right to:

If you send us suggestions, ideas, comments, or feedback about the Services ("Feedback"), you agree that we may use that Feedback for any purpose, without compensation or obligation to you, and that we do not need to keep it confidential. You grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate your Feedback into our products and services.

The Site may contain links to third-party websites or services that are not owned or controlled by Tiny Tickets. We do not endorse, control, or assume responsibility for any third-party websites, services, or content. Your interactions with any third party are solely between you and that third party.

We also use third-party service providers to operate the Site (such as our hosting provider). These providers have their own terms and privacy practices, which we encourage you to review.

To the maximum extent permitted by law, Tiny Tickets disclaims all warranties, including but not limited to:

In no event will our total liability to you for all claims arising out of or relating to these Terms or the Services exceed one hundred US dollars ($100), regardless of the cause of action or theory of liability.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Tiny Tickets and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease.

You may stop using the Services and unsubscribe from our waitlist at any time by clicking the unsubscribe link in any email we send or by emailing us at hello@tinytickets.app.

Sections of these Terms that by their nature should survive termination — including intellectual property provisions, disclaimers, limitations of liability, indemnification, and dispute resolution — will survive any termination of these Terms or your use of the Services.

12. Changes to these Terms

We may update these Terms from time to time, particularly as Tiny Tickets evolves from a waitlist into a full product. When we make material changes, we will update the "Last updated" date at the top of these Terms and, if the changes are significant, notify you by email or by posting a notice on the Site. Your continued use of the Services after we post changes constitutes your acceptance of those changes.

If you do not agree to the updated Terms, you must stop using the Services and may request removal from the waitlist.

13. Governing law and dispute resolution

Governing law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in New York County, New York. You consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.

Informal resolution

Before filing any formal legal action, you agree to first contact us at hello@tinytickets.app and attempt to resolve the dispute informally. We will make a good faith effort to resolve any dispute through informal discussion within thirty (30) days before either party initiates formal legal proceedings.

14. General provisions

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tiny Tickets regarding your use of the Services and supersede any prior agreements or understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original.

No waiver

Our failure to enforce any provision of these Terms will not be considered a waiver of that provision or our right to enforce it in the future.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, financing, sale of assets, or by operation of law.

Force majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, pandemics, internet or telecommunications failures, or labor disputes.
